OVERVIEW OF THE CONGRESSIONAL REVIEW ACT
The Congressional Review Act (CRA), enacted in 1996 as part of the Small Business Regulatory Enforcement Fairness Act, provides Congress the authority to overturn federal agency regulations through a joint resolution of disapproval. If both chambers pass the resolution and the president signs it, or Congress overrides a presidential veto, the rule is nullified, and the issuing agency is prohibited from reissuing the rule in “substantially the same form” without further congressional authorization. The CRA offers a streamlined legislative process: the resolution is not subject to filibuster in the Senate and requires only a simple majority vote, provided it is considered within 60 legislative days of the rule being submitted to Congress.
